Terms of Service for MatchPoint

These Terms of Service (“Terms”) govern your access to and use of the MatchPoint mobile application, website, and related services (collectively, the “Services”).

By creating an account or using MatchPoint, you agree to these Terms. If you do not agree, you may not use the Services.

1. About MatchPoint

MatchPoint is a social platform designed to help users discover pickleball courts, organize games, connect with other players, and participate in community-based activities.

MatchPoint does not operate, supervise, manage, sponsor, or guarantee any games, events, facilities, users, or interactions arranged through the platform.

2. Eligibility

You must be at least 13 years old to use MatchPoint.

By using the Services, you confirm that:

• You meet the minimum age requirement
• The information you provide is accurate
• You will comply with all applicable laws and these Terms

3. User Accounts

You are responsible for maintaining the confidentiality of your account and login information.

You agree not to:

• Impersonate another person
• Create false or misleading accounts
• Use MatchPoint for unlawful purposes
• Attempt to access accounts or systems without authorization

You are responsible for all activity that occurs under your account.

4. Community Conduct & User-Generated Content

MatchPoint has zero tolerance for objectionable content and abusive users. By creating an account or posting content, you agree to follow these rules and accept that violations may result in immediate removal of content and termination of your account.

You agree not to post, share, or send content that:

• Is harassing, threatening, hateful, or abusive toward others
• Is sexually explicit, violent, or otherwise inappropriate
• Is illegal, fraudulent, or promotes harmful activity
• Constitutes spam, unsolicited advertising, or solicitation
• Discriminates against or targets others based on protected traits
• Shares another person’s private information without consent
• Impersonates another person or misrepresents your identity

MatchPoint provides in-app tools to report and block users. We review reports and aim to act within 24 hours, which may include removing objectionable content and permanently banning the user who posted it. MatchPoint reserves the right to suspend or remove accounts at any time for violations of these Terms or for behavior that creates safety concerns for the community, with or without prior notice.

5. User Content

Users may post content including messages, comments, photos, profile information, and game activity (“User Content”).

You retain ownership of your User Content. However, by posting content through MatchPoint, you grant MatchPoint a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute that content solely for operating and improving the Services.

You are solely responsible for the content you share and the consequences of sharing it.

6. Games, Events & Player Interactions

MatchPoint provides tools for users to coordinate and participate in games and social activities. MatchPoint is not responsible for:

• The conduct of users
• The quality or safety of games or facilities
• Injuries or accidents
• Disputes between users
• Reliability, attendance, or behavior of participants
• Interactions that occur online or in person

Users participate in games, events, and meetups entirely at their own risk.

You understand that participating in sports and meeting other individuals may involve inherent risks, including physical injury, illness, property damage, or other harm.

By using MatchPoint, you voluntarily assume all such risks.

7. Assumption of Risk & Release of Liability

To the fullest extent permitted by law, you agree that MatchPoint, its founders, owners, affiliates, employees, contractors, and partners will not be liable for:

• Personal injury
• Death
• Property damage
• Financial loss
• Emotional distress
• User disputes
• Actions or conduct of other users
• Any damages arising from participation in games, events, or interactions facilitated through the platform

Your use of MatchPoint and participation in any activities connected to the platform is entirely voluntary and at your own risk.

8. Privacy

Your use of MatchPoint is also governed by our Privacy Policy.

By using the Services, you acknowledge that information may be collected and used as described in the Privacy Policy.

9. Third-Party Services

MatchPoint may use or integrate third-party services, including hosting providers, analytics tools, mapping services, authentication providers, or payment processors.

MatchPoint is not responsible for the availability, policies, or practices of third-party services.

10. Intellectual Property

The MatchPoint platform, branding, logos, graphics, software, and related content are owned by MatchPoint and protected by applicable intellectual property laws.

You may not copy, modify, distribute, reverse engineer, or exploit any portion of the Services without written permission.

11. Termination

MatchPoint reserves the right to suspend, restrict, or terminate accounts at any time for violations of these Terms, safety concerns, illegal activity, or misuse of the platform.

Users may stop using MatchPoint or request account deletion at any time.

12. Disclaimer of Warranties

MatchPoint is provided on an “as is” and “as available” basis.

We do not guarantee that:

• The Services will always be available or error-free
• Games or users will be legitimate, safe, or reliable
• Information shared on the platform will be accurate
• The Services will meet every user’s expectation

Use of the Services is at your sole risk.

13. Limitation of Liability

To the fullest extent permitted by law, MatchPoint and its owners, affiliates, employees, contractors, and partners will not be responsible for any indirect, incidental, special, consequential, or punitive damages arising from:

• use of the platform
• participation in games or events
• interactions between users
• injuries, disputes, or losses related to activities arranged through MatchPoint
• interruptions, errors, or issues related to the Services

Users access and use MatchPoint entirely at their own risk.

To the maximum extent permitted by law, MatchPoint’s total liability arising out of or relating to the Services will not exceed the amount paid by you to MatchPoint, if any, during the twelve months preceding the claim.

Some jurisdictions may not allow certain liability limitations, so portions of this section may not apply to you.

14. Changes to These Terms

We may update these Terms periodically. Continued use of MatchPoint after updates become effective constitutes acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and interpreted under the laws of British Columbia, Canada, without regard to conflict of law principles.
